Power of Attorney for Use Overseas

Selling property abroad, managing a bank account, settling an estate or registering a company overseas often requires a power of attorney (POA) signed in Australia. To be valid abroad, the POA usually has to be in the local language (or bilingual), signed before a notary public and then apostilled or legalised. ABC Translation coordinates every step.

Typical POA process

  • You send us the draft POA from your lawyer or agent abroad, or the requirements you have received.
  • We prepare a certified or bilingual translation.
  • You sign before an Australian notary public, which we arrange.
  • We obtain the apostille or embassy legalisation.
  • We courier the original to you or directly to your representative overseas.

Common uses

  • Selling or buying property in China, Hong Kong, Europe or Asia
  • Inheritance and estate matters
  • Bank, pension and tax matters
  • Company registration and changes of directors
  • Vehicle, household registration (hukou) and family matters

Frequently asked questions

Can you draft the power of attorney?

We are not a law firm and do not give legal advice. The wording should come from your lawyer or the receiving institution abroad. We translate it, arrange the notarisation and complete the apostille or legalisation.

Is an Australian POA valid in China?

A POA signed in Australia for use in mainland China is normally notarised by an Australian notary public and then apostilled by DFAT. A Chinese translation is usually required too. Confirm the exact format with the receiving party in China.
